Terms & Conditions

Terms for booking workshops and events.

Note: The items marked […] (legal form, company register number, VAT ID etc.) still need to be completed and the texts legally reviewed before publication.

1. Scope

These General Terms and Conditions (T&Cs) apply to all contracts concluded via this website between ArtWave, Jennifer Davison & Bea Robein, Mohsgasse 3/15, 1030 Vienna (hereinafter „ArtWave"), and customers for the booking of workshops and events. Deviating terms of the customer are not recognised unless ArtWave expressly agrees to their validity in writing.

2. Conclusion of contract and booking

The presentation of workshops on this website does not constitute a binding offer but an invitation to submit a booking. By submitting the booking form you make a binding offer. The contract is concluded with the booking confirmation by email or – in the case of online payment – with successful payment. For „on request" bookings, the contract is only concluded upon express confirmation by ArtWave.

3. Prices and payment

All prices are quoted in euros including statutory VAT. Payment is made via the payment methods offered on the website (processed by Stripe). The booking price is due upon booking. For on-request bookings, the payment method is agreed individually.

4. Consumer right of withdrawal

Consumers generally have a fourteen-day right of withdrawal for distance contracts. For contracts relating to leisure activities at a specific date or period (e.g. workshops on a fixed date), no right of withdrawal exists pursuant to § 18(1)(10) FAGG (Austrian Distance Selling Act).

5. Cancellation and rebooking

You may submit cancellation requests at any time via your customer account or by email to artwavewellness@gmail.com. Unpaid bookings are cancelled upon your request. For paid bookings we review each cancellation request individually and will get back to you promptly; no automatic refund is issued. ArtWave may cancel a date due to insufficient participant numbers or for good cause (e.g. illness of the instructor); in that case any amount already paid will be refunded in full. No further claims exist.

6. Participation requirements

Participation in workshops is at your own risk. Our offerings are creative wellbeing offerings and do not replace medical, psychotherapeutic or clinical treatment. If you have health restrictions, please clarify with your doctor beforehand whether participation is suitable for you and inform us in good time of any relevant limitations.

7. Liability

ArtWave is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In cases of slight negligence, ArtWave is only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. No liability is assumed for items brought by participants.

8. Photo and video recordings

Photo and video recordings may be made at events for documentation and publicity purposes. If you do not wish to be depicted, please let us know on site or in advance by email; your wish will of course be respected.

9. Copyright

All materials, content and concepts provided in the workshops are protected by copyright and may not be reproduced, distributed or made publicly accessible without the express consent of ArtWave.

10. Applicable law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory provisions of the law of their country of habitual residence. The place of jurisdiction is – as far as legally permissible – Vienna.

11. Severability

If individual provisions of these T&Cs are or become invalid, the validity of the remaining provisions remains unaffected.
